General Terms and Conditions
Belinda Murphy organises and leads hiking and snowshoeing tours. These are hereafter referred to collectively as "tours"Registration / Conclusion of Contract Registration can be made by email or by using a booking form. After registering, the participant (hereinafter referred to as "participant") will receive written confirmation from Belinda Murphy (hereinafter referred to as "organiser"). From that moment on, the registration is binding. These General Terms and Conditions therefore form an integral part of the contract between the participant and the organiser. Participation Requirements Being in good health and having appropriate equipment are necessary for all tours. By registering, the participant confirms that they meet the physical and technical requirements for the tour. If the participant does not meet these requirements, the organiser may decide to exclude them before departure or during the tour. In the event of exclusion for the reasons mentioned above, no refund will be issued. Groups Participation in a group offers requires tolerance, adaptability, and understanding of different abilities within the context of the tour’s demands. The organiser reserves the right to exclude any participant who cannot integrate into the group, without entitlement to a refund. Services The services included in the price vary depending on the offer. Details can be found in the tour description. Program Changes As a rule, tours take place in all weather conditions. Weather conditions or participants’ condition may result in short notice changes to the program, area, or route. The participant accepts any such changes made by the organiser. All additional travel and accommodation costs are the responsibility of the participant. Payment Conditions After receiving the registration confirmation, payment is due according to the details on the invoice.If payment is not received on time, the organiser may cancel the contract and charge cancellation fees in accordance with the section “Cancellation by the Participant.” Cancellation by the Participant If the participant cancels their booking before the start of the tour, the following fees apply in addition to the processing fee of CHF 50: · 30 to 21 days before start: 30% of the invoice amount · 20 to 11 days before start: 50% of the invoice amount · 10 to 0 days before start: 100% of the invoice amount · If a participant is absent or interrupts their participation prematurely, they are not entitled to any refund. Cancellation by the Organiser In exceptional situations (e.g., high avalanche danger, severe weather, illness, etc.), the organiser may cancel tours at very short notice. Amounts already paid will be refunded in full. Any further claims are excluded. In the event of premature cancellation due to force majeure, there is no entitlement to a refund. Insurance Accident, health, liability, and theft insurance are the responsibility of the participant. REGA membership and travel cancellation insurance are recommended. Liability The qualified organiser provides participants with the highest possible level of safety. However, due to the risks associated with the outdoors and mountain environments, a residual risk cannot be excluded. By registering, the participant expressly acknowledges these risks. The organiser accepts no liability in cases of slight negligence, participant fault, third-party fault, or force majeure. The organiser is not responsible for theft, loss, or damage to the participant’s equipment or rented equipment. Data Protection The organiser uses client data for processing registrations and sending their own newsletter. Data is not shared with third parties. Applicable Law and Place of Jurisdiction The contractual relationship between the participant and the organiser is subject to Swiss law. The place of jurisdiction is St-Triphon, VD
